Hirsch’s Trade-In Initiative

TERMS & CONDITIONS OF HIRSCH TRADE-IN INITIATIVE

  1. Definitions

    Unless the context provides otherwise, the words and expressions set out below will have the following meanings and cognate expressions shall have corresponding meanings:

    1. “Trade-in Initiative” means the Trade-in Initiative organised by the Supplier, open to all people residing in the Republic of South Africa.
    2. The “Supplier” means Home of Living Brands whose registered office is at Home of Living Brands (PTY) Ltd, West Block, Pineslopes Shopping Centre, Corner Straight and Witkoppen Road, Fourways.
    3. The “Retailer” means Hirsch’s Home Appliance Store whose registered office is at 1211 Umgeni Road, Durban, 4025.
    4. Although the trade-in initiative may feature on Facebook, this Trade-in initiative is in no way sponsored, endorsed, or administered by, or associated with their platforms.
    5. “Trade-in Initiative Period” means the period between the Date 01/08/2023 and midnight on the End Date 31/10/2023.
    6. “Discount” means the R150 (one hundred and fifty rand) discount that will be applied to the retailers’ customers account, see Clause 3.2 for eligibility of discount.
    7. “Discount Redemption” refers to the eligibility of a customer to receive the trade-in value on their retailer account.

  2. Application of Terms and Conditions

    1. By choosing to participate in the trade-in initiative, the Participant agrees to be bound by the following terms and conditions, which the Participant acknowledges to have read and understood.
  3. Trade-in Value Terms

    1. In order to be eligible for the trade-in value the Participant must:

      1. Successfully adhere to the trade-in value stipulations set out in clause 3.2.
      2. Agree to permit the Retailer and Supplier to collect their personal information for the purpose of the sale for the purchased product/s.
      3. Undertake to abide by these Rules.
    2. To be eligible for the Discount Redemption, Participants must:

      1. Visit the Retailers stores and physically trade-in 1 (one) kettle of any brand for one (1) discount applied to their retailer customer account.
      2. Only provide an electric kettle for trade-in
      3. Purchase a Russell Hobbs kettle from the cost value to the Supplier of R400 (Four hundred rand) or Retailer Sales Price of R600 (Six hundred rand) and up to redeem the discount. The discount can only be applied to the following article codes, dependant on stock as well as the status of the article: 862224, 862794, 858199, 859214, 861762, 862518, 862308, 862753, 862301, 859228, 862790, 862805, 862780, 862806, 862785, 862779 and 861258; unless otherwise confirmed with the Supplier.
    3. The customer cannot accumulate discounts at the Retailers stores, through the trade-in initiative, and apply it to another product besides a Russell Hobbs electric Kettle.
  4. Use of Personal Information

    1. Personal information is information relating to a Participant. Personal information includes a Participant’s identity number, passport number and contact details.
    2. As far as the law allows, each Participant agrees and gives the Retailer permission to collect, get, receive, record, organise, collate, store, update, use and share all of his/her personal information for all purposes relating to the Trade-in Initiative, and/or sale goods.
    3. Each Participant warrants that he/she has the authority to allow the Retailer to use his/her personal information for purposes of the sale and delivery of goods. The Retailer and Supplier will not use any Participant’s personal information in any way which breaks the law and undertakes to keep all personal information of Participants secure and for as long as the law requires.
    4. By entry in this Trade-in Initiative/sale and delivery of goods, all Participants consent to having their data captured on the Retailers’ system.
    5. The Retailer and Supplier will not use any Participant’s personal information in any way which breaks the law and undertakes to keep all personal information of Participants secure and for as long as the law requires.
  5. Warranties and Indemnities

    1. The Suppliers and the Retailers, its employees, officers, directors, agents and associates and the social media sites, their employees, officers, directors, agents and associates (the “Indemnified Parties’’) shall not be liable for and the Participants hereby indemnify and hold the Indemnified Parties harmless from any claim, liability, cost, expense or penalty suffered or incurred by any person as a result of participating in the Trade-in Initiative.
  6. Stock availability

    1. The discount redemption is limited to stock availability. Once stock has run out the discount is no longer applicable and only applies while stocks last.
  7. Force Majeure

    1. In the event of any act of God, strike, war, warlike operation, rebellion, riot, civil commotion, lockout, combination of workmen, interference of trade unions, suspension of labour, fire, accident, or (without regard to the foregoing enumeration) of any circumstances arising or action taken beyond or outside the reasonable control of the Promoter preventing them from the performance of any obligation to a Participant (any such event hereinafter called "Force Majeure") then the Promoter shall be relieved of all such obligations to the Participant during the period that such Force Majeure continues and shall not be liable for any delay or failure in the performance of any obligations or loss or damage which the Participant may suffer due to or resulting from the Force Majeure.
  8. General

    1. The Supplier may in its sole and absolute discretion amend these terms and conditions at any time, by publishing the revised terms and conditions on the Russell Hobbs Website (https://www.russellhobbs.co.za).
    2. In the event of a dispute regarding any aspect of the Trade-in Initiative and/or these terms and conditions, the Supplier’s decision will be binding and final and no correspondence will be entered into.
    3. The Supplier and Retailer reserves the right to cancel, suspend or terminate the Trade-in Initiative at any time in writing and once mutually agreed, but without notice to the Participants.
    4. The discount is not redeemable for cash or other Russell Hobbs goods except for the product articles mentioned in clause 3.2.2.
