Introduction

  • These terms and conditions form the basis upon which the supplier, Home of Living Brands (Pty) Ltd, (“HOLB”), agrees to provide you services by means of this website. Please make sure that you have read and understood all the terms and conditions before proceeding to utilise the services contained therein. 
  • Any provision of these terms and conditions which are or become unenforceable due to being void, invalid, illegal, unlawful or for any reason that may be considered just or rational, shall be treated as severable from the remaining provisions which will remain in full force and effect.
  • No rights or obligation contained herein can be ceded or assigned under this agreement.

Acceptance

  • The information contained on this website is provided by HOLB for the purposes of advertising and selling Russell Hobbs products, and subject to the following terms and conditions which govern the supply of the products purchased by yourself on the website. By using this facility you agree to be bound by the terms and conditions herein set out and that you accept all terms contained therein.
  • This agreement is governed by the laws of the Republic of South Africa and shall be governed by the courts within.

Verification

  • To place an order, you must be 18 years of age or older, and upon using this website you warrant to HOLB that you have the legal capacity to conclude a contract that is legally binding.
  • By using this website you also verify and agree that all the information you provide is correct and that it originates from you or from someone acting within your personal authority and that any instructions received by HOLB shall be deemed to be correct and binding and free from any liability attaching to HOLB and you indemnify HOLB against all and any claims, damages, liability arising from your instructions and orders or those purported to be yours.
  • HOLB also reserves the right to request further information should the need arise.
  • HOLB may, from time to time, require you to change your password and the responsibility will be yours to follow the instructions.
  • HOLB reserves the right to deactivate your account should there be any infringement of the terms and conditions in the agreement.
  • HOLB, our affiliates and/or subsidiaries reserve the right to refuse, terminate accounts, cancel orders and/or remove and edit content at our sole discretion.
  • HOLB also reserves the right to request confirmation of banking details or identification and to approve purchases at their own discretion.

Entering into a contract/placing an order

  • To place an order to purchase a product, you must follow the instructions and create an online identity by registering an account, with a username and password, and it is at your sole discretion to disclose your username and password to third parties, we recommend this information is kept confidential.
  • A product order is deemed a request for the product, and is subject to availability, and it is your responsibility to submit the order according to the instructions and it is your responsibility to ensure the order details are entered correctly. HOLB reserves the right to cancel or reject an order without giving reasons should it be deemed necessary.
  • All orders will be confirmed and confirmation of receipt of the order will be issued once the order has been received. Goods are only shipped, and the order processed once payment has been received.

  • Payment can be made by via the PayU portal for approved credit cards and Direct/Electronic transfer of funds (EFT).

  • At the time of placing the order, the transaction details are presented to the bank and an authorisation is obtained for the amount of the order.

  • Note: to protect its own and the interests of its customers, HOLB along with our third-party financial services, scrutinises all transactions very carefully to prevent attempted fraud and a transaction may be refused if HOLB is not satisfied with its legitimacy.
  • Upon successful payment and confirmation of your order, the order cannot be reversed. Cancellation of orders will be allowed only in terms of the cancellation and returns policy and according to the provisions of the Consumer Protection Act 68 of 2008. Please note that the delivery/collection fee of cancelled or returned orders are non-refundable. Any missed deliveries/collections not collected within the designated timeframe will be subject to a redelivery fee.
  • The contract will be deemed to have been concluded only once the product has been delivered.
  • The product will be delivered within 1 - 3 working days (local and regional) and 4 - 7 working days (remote/outlying areas) from the confirmation of the order being received. Note that payment must be received prior to the order being confirmed.
  • Do not resubmit your order immediately if there are any technical or other errors as it might lead to a duplication of the order. Please contact our customer services if you are unsure of the confirmation of your order.
  • HOLB does not accept responsibility for the late deliveries due to incorrect delivery details being supplied. From time to time, HOLB may offer products for sale as part of the service. HOLB reserves the right to change the descriptions, specifications, and prices of the products offered on the service without notice and at any time. HOLB does not warrant that such descriptions, specifications and prices of such products are accurate, complete or current at all times. Such products may not be available for delivery to your country of residence. Our delivery to you of an email confirmation following your placement of an order does not constitute our acceptance of such order, and we reserve the right to reject such order or limit the quantity of products under such order as we see fit.

  • The pricing is also subject to change from time to time and HOLB will not be held liable for any amendments or pricing changes, however pricing will be confirmed prior to the order being processed.

  • Any unauthorised copying, distributing, sharing or misappropriation are not permitted, and you may not use this website or any content therein for any defamatory or unlawful means or purposes and the user indemnifies HOLB for any liability from such harmful, unauthorised or unlawful use. Disclaimers, Warranties and Limited Liability

  • HOLB shall not be held liable for any direct, indirect, contingent or consequential losses sustained by you or any third party resulting from your use of this website or the information contained therein or from any damages sustained from the cancellation or termination of an order.
  • HOLB does not guarantee access to this website and only that we do what is reasonably expected to maintain it and repair any faults. Whilst every effort is made to keep the information on our website up to date, the user indemnifies us against any loss, damage or liability related to the users use of this website or any terms or provisions that are defective or invalid.
  • HOLB reserves the right to amend and/or modify these terms and conditions, or the services provided on the website, as and when they see fit and makes no representations or warranties, express or implied, as to the accuracy, reliability or correctness of any information or content contained on this website, and that it is free of latent defects, errors, malicious software or infringing content, and reserves the right to alter or amend the content from time to time without notice.
  • In the event of a Force Majeure the party upholding force majeure will do its best as is reasonable to be expected to overcome the impediment prior to claiming non-performance for matters beyond their control and in which case neither party will be held liable.

Please read below for more information regarding our warranty terms and conditions.


  • Home of Living Brands (Pty) Limited ("Home of Living Brands") warrants to the original purchaser of this product ("the customer") that this product will be free of defects in quality and workmanship which under normal personal, family or household use and purpose may manifest within a period of 1 (one) year from the date of purchase ("warranty period").

  • Home of Living Brands shall extend the warranty period for a further period of 1(one) year ("extended warranty period"), on condition that the purchaser registers the product on the website, within 12 months from the date of purchase of the product.   • Where the customer has purchased a product and it breaks, is defective or does not work properly for the intended purpose, the customer must notify the supplier from whom the customer bought the product ("the supplier") thereof within the warranty period or if applicable, the extended warranty period. Any claim in terms of this warranty must be supported by a proof of purchase. If proof of purchase is not available, then repair, and/or service charges may be payable by the customer to the supplier.

  • The faulty product must be taken to the supplier's service centre to exercise the warranty.

  • The supplier will refund, repair or exchange the product in terms of this warranty subject to legislative requirements. This warranty shall be valid only where (a) the customer is not the cause of the product breaking, and (b) the product has been used for the intended purpose stipulated in the product manual. The warranty does not include and will not be construed to cover products damaged as a result of disaster, misuse, tamper, abuse or any unauthorised modification or repair of the product.

  • This warranty will extend only to the product provided at the date of the purchase and not to any expendables attached or installed by the customer. In this regard any accessories supplied with the product by the supplier, may be excluded in this warranty or extended warranty (see Exclusions to Warranty and Extended Warranty document).

  • If the customer requests that the supplier repairs the product and the product breaks or fails to work properly within 3 (three) months of the repair and not as a result of misuse, tampering or modification by or on behalf of the customer, then the supplier may replace the product or pay a refund to the customer, subject to the supplier's discretion.

  • The customer may be responsible for certain costs where products returned are not in the original packaging, or if the packaging is damaged. This will be deducted from any refund paid to the customer.

EXCLUSIONS TO WARRANTY AND EXTENDED WARRANTY

  • Any accessories supplied with the product, including but not limited to, bowls, jugs, mills or carafes made either of glass or plastic and supplied with this appliance (hereinafter referred to as "the accessory or accessories"), is warranted to be free from material and workmanship defects for the duration of the appliance warranty.

  • The accessories should give trouble free service when used in accordance with the directions described in the instruction manual. However, the accessories will be damaged if subjected to impact, and this damage is not covered by the warranty. Such impact damage can occur either from the outside (if for example it is dropped or knocked against a hard surface), or from within (if for example foreign objects are placed within the accessories and the power is switched on).

  • Should you need to replace an accessory during the warranty period; a claim for a free replacement will only be considered if the item (including all shards and broken parts) is returned to the nearest HOLB service centre for examination.

  • The remains of the accessory will be carefully examined by the relevant professionals and if it is determined (at the sole discretion of HOLB) that the damage was caused by impact, then the claim will be refused and will not be covered by the warranty or any extended warranty.

  • Any replacement part provided in terms of clause 4 above will become a chargeable item payable by the customer.
